Payment & Refund Policy

Lemoney ("Lemoney" or "Lemoney App") is a payment solution application which facilitates payment Transactions (as defined in the "Terms of Use") so You may send payments to Users, Merchants, billers or third parties using your Lemoney account, debit card, credit card, UPIs, electronic and mobile wallets ("Payment Instruments") and/or any other Payment Instruments accepted through Lemoney. You may also receive payments from other Users or third parties in the Payment Instrument you designated in Lemoney to receive funds. In addition, Lemoney allows you to communicate with or receive communications and offers from other Users, Merchants and billers. This Payment & Refunds Policy is to be read pari passu with the Terms of Use and is an extension of the same. Therefore all defined terms therein apply herein and vice versa.

The Payment Transactions or any communication/offers carried out through Lemoney are solely between the sender and the recipient of the payment. Lemoney facilitates a link between the sender, the recipient and the respective payment system providers to make and/or receive payments using the payment system provider services. Once a Transaction has been authenticated, authorised and processed through the Services, the payment will be settled directly with the recipient by the respective payments participants. Lemoney neither receives the funds pertaining to the Transaction nor plays a role in the settlement of such Transaction.

The User specifically and expressly understands and agrees that Lemoney is: (a) a facilitator of the Transaction(s); (b) not a party to the Transaction(s); (c) not responsible to the User in any manner whatsoever, with respect to settlement of payment relating to any Transaction; (d) not and will not be responsible for any aspect of the products or services User purchases; (e) not and will not be responsible for any communications made by User or any communication or offers made to User through Lemoney; (f) not a party to and will not be responsible for any disputes, chargebacks or reversals arising pursuant to the Transaction(s); (g) not responsible for any act of a User, including, non completion of a Transaction; and/or (h) the facilitation of a Transaction does not guarantee that the sender has sufficient funds available in the funding account he or she used, that the Transaction will be authorized or processed, or that the Transaction will not later result in a chargeback or other reversal.

COMMUNICATIONS WITH PAYMENT PARTICIPANTS:

By electing to use Lemoney, you authorize it to communicate with any billers or payment participants or any third party provider to provide or obtain any information including Your personal information, for the purpose of processing the Transaction or providing Lemoney Services or for risk management and fraud assessment purposes. You understand that Lemoney may also share any message that you send other Users, Merchants, billers, at the time of requesting or making a Transaction as may be required by and in accordance with Applicable Laws.

COMPLIANCE WITH PAYMENT PARTICIPANTS’ RULES:

As You will be using the payment participants’ services to process your payment instructions, You consent and agree to comply with the rules, guidelines, directions, instructions, requests, etc. issued by the respective participants from time to time ("Payment Participant Rules"). You acknowledge and agree that You are responsible for keeping yourself up-to-date and complying with all such Rules. If You fail to comply with the obligations imposed on You by Us or the relevant participants, we may suspend or terminate your Lemoney account. For the avoidance of doubt, the Payment Participant Rules are between you and the respective participant. Lemoney is not liable for any actions or inactions of such participants.

THIRD PARTY PROVIDERS.

In addition, Lemoney may have arranged for third party providers to provide products or services to you through Lemoney ("Third Party Providers"). In order to use these products or services, you may be required to agree to additional terms and conditions from such Third Party Providers, and may be subject to additional requirements of the Third Party Provider. By agreeing to the Lemoney Terms or continuing to use Lemoney Services, you hereby agree to any Third Party Provider terms that apply to your use of such products and services through Lemoney, which may be updated from time to time. For the avoidance of doubt, the Third Party Provider terms are between you and the applicable Third Party Provider, not Lemoney. Lemoney is not liable for any actions or inactions of such Third Party Providers.

PAYMENT PARTICIPANTS OR THIRD-PARTY FEES:

You may incur access or data fees from the Payment Participants or Third Party Providers in connection with your use of Lemoney. You are responsible for all such fees.

LEMONEY FEES:

Fees may be applied to certain Transactions or use of Lemoney Services. Prior to completing each Transaction, you will be notified of any fees that may apply. Fees may be determined by Lemoney in its sole discretion and any fees charged will be inclusive of all applicable taxes.

CANCELLATION/REFUND:

The cancellation/refund in respect of the bookings and charges, if any, will also be governed as per the terms and conditions of the aggregator or of the Merchant/vendor. Lemoney has no role in governing refund/cancellation charges. Lemoney, being an online marketplace services provider, will not be responsible for refund/cancellation including any charges arising therefrom. The aggregator or the Merchant/vendor is solely responsible for the content/listings/bookings made available by it through the Lemoney Platform and You should contact the respective aggregator or Merchant/vendor directly in relation to the above mentioned queries.

REFUNDS AND CHARGEBACKS:

Except as set forth in these terms, all Transactions processed through the Lemoney Services are non-refundable to the sender by Lemoney and are non-reversible by the sender through the Lemoney Services. You may have additional refund or chargeback rights under your Payment Instrument issuer agreement or under applicable regulations. You should review the statements you receive from the issuer of your Payment Instrument which should reflect all Transactions through the Lemoney Services.

In the event that the Sender’s Payment Instrument issuer requests a chargeback for a Transaction, Lemoney reserves the right to reverse the Transaction amount. Lemoney further retains the rights to set-off any chargeback amount from subsequent payments to be transferred to the recipient.

Notwithstanding the above, the Lemoney App supports refund in the event it meets the criteria that have been specified for the relevant use cases. Once the refund is initiated, it may take up to 30-45 business days from the time the refund was initiated. The refund will be processed and the money will be credited to the same card or Payment Instrument which was used at the time of the original transaction. In all cases, You will be able to check the status of the refund with our support team with the help of the Transaction ID. The refund criteria along for the specific use cases are as follows,

A. Refund within Send Money: It is the responsibility of the receiver / payee to provide correct details for the money to be credited into the bank account. Once the money is credited to the bank account, refunding the amount will follow bank guided procedures.
If you have sent money to one of your contacts, Lemoney will refund the money to you according to the following scenarios
(a) The receiver / payee has not registered with Lemoney within 3 days of the date from which the transaction has been initiated; or
(b) The receiver / payee, who is a registered Lemoney user has not specified a bank account for the money to be credited to within 3 days of the date from which the transaction has been initiated; or
(c) The receiver / payee has specified an invalid bank account to Lemoney due to which the money transfer to the receiver’s bank failed

B. Refund within Quick Payments: All payments on Payment for mobile/DTH recharge, Bill Pay, P2P transfers are final. Such transactions cannot be refunded/ returned or cancelled once initiated. Lemoney is not responsible for any purchase of prepaid recharge for an incorrect mobile number or DTH account number or incorrect toll or data card information. However, if in a transaction performed by You on the Lemoney Platform, money has been charged to Your card or bank account and a recharge is not delivered within 24 hours of the completion of the transaction, then You shall inform us by sending an e mail to our customer services e mail address mentioned on the ‘Contact Us’ page on the Lemoney Platform. Please include in the e-mail the following details – the mobile number (or DTH account number or data card or toll-tag information), operator name, recharge value, transaction date and order number. Lemoney will investigate the incident and, if it is found that money was indeed charged to Your card or bank account without delivery of the recharge, then Lemoney without promising shall endeavour to refund the money within 21 working days from the date of receipt of Your e mail. It may take 3-21 working days for the money to show in Your bank account depending on Your bank’s policy.

C. Refund at Merchant Stores: Lemoney supports both partial and full refunds for purchases made at Lemoney enabled merchant stores only if the original transaction was initiated using the Lemoney payment platform. While, the functionality is supported, the refund process & policy is governed by the merchant’s store return / refund policy. If the merchant initiates the refund, it will again go through the process specified hereinabove.

COUPON REDEMPTION: In addition to the T&Cs, coupon redemption is subject to standard and specified terms and conditions mentioned by respective retailers. Coupons are issued on behalf of respective retailers. Hence, any damages, injuries, losses incurred by the You as a result of using the coupon is not the responsibility of Lemoney and its affiliates, and each of their directors, officers, employees.

PAYMENT POLICY: The online payment mode includes credit cards, debit cards, net banking, e-wallets, etc. We accept payments made by most of the major credit/debit cards issued in India. Acceptance of payment is at Our sole discretion and We reserve the right to deny acceptance of any mode of payment without any prior notice. We don't accept internationally issued credit/debit cards, which are issued outside India and certain cards issued by banks in India too.

While availing any of the payment method(s) available on the App, we will not be responsible or assume any liability, whatsoever in respect of any loss or damage arising directly or indirectly to You due to:
(a) Lack of authorization for any transaction(s), or
(b) Exceeding the limit set up your issuing bank, or
(c) Any payment issues arising out of the transaction, or
(d) Decline of transaction for any other reason(s).

Lemoney will not be liable for any credit / debit card fraud. The liability for use of a card fraudulently will be on You and the onus to prove otherwise shall be exclusively on You. All information collected by us shall be governed as per our Privacy Policy. Lemoney will not be responsible for any transactions You make for using any portion of the Service(s). All claims and complaints for any failed or incorrect transactions must be directed to our payment processing partners and/or Your bank (as the case may be).

Lemoney reserves its right to change the price of any Service(s), tariff plans, available through the App any time without any notice, to the extent permitted under applicable laws, regulations, orders and/or directions. All payments made against transacting of Service(s) on the App shall be in Indian Rupees only. The App or the payment gateways associated with it will not facilitate transaction with respect to any other form of currency with respect to the purchases made on App.

You represent and confirm that the credit/debit card that is being used is Yours or that You have been specifically authorized by the owner of the credit/debit card to use it. You further agree and undertake to provide the correct and valid credit card details to carry out a transaction on the App. All credit/debit card holders are subject to validation checks and authorization by the card issuer. If the issuer of Your payment card refuses to authorize the payment to Us, We will not be liable for any delay or non-delivery. Lemoney reserves the right to impose limits on the number of transactions which Lemoney may receive from an individual valid credit/debit/ valid bank account and reserves the right to refuse to process transactions exceeding such limit. You acknowledge that Lemoney will not be liable for any damages, interests, claims etc. resulting from not processing a transaction or any delay in processing a transaction which is beyond the control of Lemoney.

You agree that if You provide any information that is untrue, inaccurate, not current or incomplete or We have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, or not in accordance with the this Terms of Use, We shall have the right to indefinitely suspend or terminate or block access to Your Account.

We shall ensure that all Your confidential data pertaining to money transactions, bank account details and all other sensitive personal information are protected and kept confidential by employing the best available protection standards elaborated in our Privacy Policy.

We retain the right to share the details of any Transaction undertaken using the account and the end beneficiary/ KYC details with RBI, as per statutory guidelines issued from time to time. We further reserve the right to suspend Your Lemoney account if You are involved in any suspicious transaction and/or any transaction in gross violation of the rules and regulations issued by the Reserve Bank of India ("RBI"), governing the use of Pre Paid Payment Instruments including but not limited to rules and regulations under Prevention of Money Laundering Act, 2002 and any amendments thereto. In such an event, Phonepe shall report the matter to RBI and shall also freeze your Lemoney account until the receipt of findings, and clear report from RBI in this regard.

USER OBLIGATIONS:

(a) You must ensure the availability of sufficient funds before executing any transaction from your Account.
(b) If you have submitted KYC documents to Us, You shall intimate us about change in your address, if any, in writing along with such proof of address as per the KYC documents.
(c) Your Lemoney account and wallet if any might be a trusted instrument with certain merchants after validating your identity, in such cases misuse of wallet because of auto-authentication on same device because of lost/theft/misuse of device or information will be solely User's responsibility.
(d) You acknowledge, represent and warrant that the MPIN generated by the You, at any time, provides access to the fund transfer through your linked bank a/c and that You are the sole and exclusive owner, and the only authorized user of the MPIN. You accept sole responsibility for use,
confidentiality and protection of the MPIN as well as for the Services availed through the use of MPIN. The MPIN is issued and verified by the Bank and is neither stored nor accessed by Lemoney. The User grants express authority to Lemoney for carrying out instructions authenticated by such MPIN. The User unconditionally undertakes to have MPIN of such number of digits as may be notified by the bank from time to time and to ensure that the same is kept confidential. If the User forgets the MPIN, then the User may regenerate the MPIN from his/her/its Lemoney App.
(e) User authorizes Lemoney to forward to Your bank, Your request to debit your linked bank account when You link your account with Lemoney App. You are solely responsible for complying with any terms set by Your bank or with respect to Your account, including any fee terms, such as non-sufficient fund or overdraft fee terms.
(f) User shall promptly inform Us of any unauthorized usage of Your account, lost/stolen/misplaced/ device or account details, and any other circumstances which may lead to unauthorized usage of Your account. The responsibility of any transaction prior to intimation, will solely be on the registered User.

MERCHANT SERVICES:

You agree and understand that when You acquire goods or any other services from a Merchant platform through Lemoney Services, We are not a party to the contract between You and the Merchant. We do not endorse any advertiser or Merchant linked to its website or app. Furthermore, We are under no obligation to monitor the Merchant's service used by You; the Merchant alone will be responsible for all obligations under the contract including (without limitation) warranties or guarantees. Any dispute with or complaint against any Merchant must be directly resolved by the User with the Merchant. It is clarified that We shall not be responsible or liable for any deficiency in goods and/or services purchased using Lemoney services. You are instructed to satisfy yourself regarding the quality, quantity and fitness of any good and/or service before purchasing the same. In case any amount is transferred erroneously by You to any Merchant or any other person, Lemoney shall not be liable to refund such amount to You any circumstances.

TAXES & DUTIES:

You should be solely responsible for payment of any taxes, duties or other governmental levies or any financial charges that may be imposed on any products or services purchased or supplied through the Services or otherwise arising from online transactions.

FOREIGN CURRENCY:

You shall ensure that the Lemoney Services are not used for Transactions in foreign currency. Lemoney services are issued & shall be valid only in India and shall be used at Merchants only in India.

ANTI-MONEY LAUNDERING POLICY:

Lemoney strongly condemns and prohibits money laundering and any activity that facilitates money laundering or financing of terrorist or criminal activities. At Lemoney the directors, officers, employees and any other individuals or organisations associated with Lemoney are supposed to adhere to the applicable law.

UNAUTHORIZED TRANSACTIONS:

An unauthorized transaction occurs when a payment is made from Your account that You did not authorize. If you provide access to Your account to a third party (by disclosing your login or/and MPIN information or any other information) and they conduct transactions without Your knowledge or permission, You are responsible for any resultant use. The liability of any misuse is solely Yours, until you report the issue Lemoney. You should immediately notify Lemoney if you believe:
(a) there has been an Unauthorized Transaction or unauthorized access to your account;
(b) there is an error in your account history statement (you can access your account history statement by logging into your app and go to transaction history section;
(c) your Lemoney username and password and/or bank account MPIN has been compromised;
(d) your device with the Lemoney App has been lost, stolen or deactivated.

LEMONEY ERRORS:

We will rectify any error that we discover. If the error results in your receipt of less than the correct amount to which you are entitled, Lemoney may credit your account for the difference. If the error results in your receipt of more than the correct amount to which you are entitled, Lemoney may debit the extra funds from your account.

USER ERRORS:

If you erroneously send a payment to the wrong party, or send a payment for the wrong amount (for instance a typographical error at your end) your only recourse will be to contact the party to whom you have sent the payment and ask them to refund the amount. Lemoney will not reimburse you or reverse a payment that you have erroneously made.

NO LIABILITY:

Lemoney assumes no responsibility and shall incur no liability if it is unable to affect any payment instruction(s) on the payment date owing to any one or more of the following circumstances:
(a) If the payment instruction(s) issued by You is/are incomplete, inaccurate, invalid and delayed;
(b) If the payment account has insufficient funds/limits to cover for the amount as mentioned in the payment instruction(s);
(c) If the funds available in the payment account are under any encumbrance or charge;
(d) If Your bank or the National Clearing Centre refuses or delays honouring the payment instruction(s);
(e) If payment is not processed by biller upon receipt;
(f) Circumstances beyond the control of Lemoney (including, but not limited to, fire, flood, natural disasters, bank strikes, power failure, systems failure like computer or telephone lines breakdown due to an unforeseeable cause or interference from an outside force).
In case the bill payment is not effected for any reason, You will be intimated about the failed payment by an e-mail.
